1. Acceptance of Terms

By accessing or using AeroKeep (the "App"), you affirm that you are at least 18 years old, or, if you are not, that you have obtained parental or guardian consent to use the App. If you do not meet these requirements, you must not access or use the App.

2. Description of Services

The App provides tools to help aircraft owners, operators, and pilots track aircraft times (tachometer/Hobbs), manage recurring maintenance tasks and schedules, log completed maintenance and squawks, keep a personal record of flights, track pilot currency (such as flight reviews, medical certificates, and takeoff/landing and instrument currency), and receive optional reminders.

3. User Responsibilities & Aviation Safety Compliance

If you sign in, you are responsible for maintaining the security of the Apple or Google account you use to sign in, and for all activities that occur under your AeroKeep account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Aviation Compliance and Responsibility: As an aircraft owner, operator, or pilot in command, you bear sole and absolute responsibility for the airworthiness of your aircraft, performing necessary maintenance, and fully complying with all federal, national, or local aviation laws, rules, and safety regulations (including, but not limited to, FAA regulations in the United States). The App is purely a record-keeping aid and scheduling assistant. Under no circumstances does the use of this App relieve you of your legal, professional, or regulatory duties regarding aircraft maintenance, inspections, pre-flight safety checks, or airworthiness determinations. The App does not replace the judgment of an FAA-certificated mechanic (A&P) or Inspection Authorization (IA), and it is not an official aircraft maintenance record.

Pilot Currency and Flight Records: As pilot in command, you are solely responsible for ensuring that your flight reviews, medical certificate, takeoff and landing currency, instrument proficiency, and applicable ratings and endorsements are current and valid before every flight (including under 14 CFR § 61.56 and § 61.57). Flight records in the App are for personal reference and are not an official logbook under 14 CFR § 61.51. These responsibilities are also described in the Airworthiness Notice and Pilot Currency Notice shown in the App, which form part of these Terms.

4. Acceptable Use

You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the App by any third party. You may not attempt to gain unauthorized access to the App, its servers, or other users' data; interfere with or disrupt the App or its services; reverse engineer the App except as permitted by law; or use the App to store unlawful content.

5. Intellectual Property

All content included on the App, such as text, graphics, logos, images, and software, is the property of Candidus LLC or its content suppliers and protected by United States and international copyright laws. Unauthorized use of any content may violate copyright, trademark, and other laws.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what information we collect and how we use it.

7. Subscriptions and Billing

7.1 Premium Subscription

The core features of the App are available free of charge. You may upgrade to the AeroKeep Premium subscription to unlock additional features, such as managing multiple aircraft, real-time cloud sync and backup across devices, and server-sent reminders. Pricing and available subscription terms are displayed on the upgrade page within the App. If your subscription ends, your data remains on your device but will no longer be synchronized.

7.2 Billing

Payment for the Premium subscription is charged to your Apple App Store or Google Play account at confirmation of purchase. Subscriptions automatically renew at the selected price and interval unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage your subscription and turn off auto-renewal in your App Store or Google Play account settings.

7.3 Refunds

Refunds are generally not provided for subscription payments, except as required by applicable law or the policies of the platform through which you made the purchase (e.g., Apple App Store, Google Play Store).

8. Limitation of Liability

To the maximum extent permitted by applicable law, Candidus LLC, its affiliates, officers, directors, employees, agents, suppliers, or licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, resulting from your use or inability to use the App.

Aviation Disclaimer and Release: Operating and maintaining aircraft is an inherently high-risk activity that carries potential risk of severe property damage, serious bodily injury, and death. You agree that using this App is at your own risk. Candidus LLC, its officers, members, and employees, accept no responsibility, liability, or duty of care for any consequences resulting from your use of the App, including but not limited to aircraft malfunctions, regulatory non-compliance, flight delays, engine failures, crashes, property destruction, bodily injury, or death. You hereby release Candidus LLC from any and all liability associated with such occurrences.

9. Disclaimer of Warranties & Maintenance Suggestions

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Candidus LLC makes no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App. You expressly agree that your use of the App is at your sole risk.

Suggested Maintenance Items: Any preloaded or suggested maintenance tasks, intervals, checklists, regulatory references, currency calculations, or reminders provided within the App are for informational purposes only. These suggestions do not constitute official aviation advice, service bulletins, or airworthiness directives. Candidus LLC makes no representation or warranty regarding the correctness, accuracy, completeness, safety, or currency of these suggestions. It is your sole responsibility to verify all maintenance requirements, intervals, and compliance thresholds against the official aircraft manufacturer's manuals, Federal Aviation Regulations (FARs), and official directives before operating the aircraft or logging maintenance.

Reminders and Sync: Notifications and reminders are a convenience only. They may be delayed, missed, or not delivered (for example, because of device settings, connectivity, or service outages), and you must not rely on them as your only means of tracking maintenance or currency. We do not guarantee that cloud sync or backups will be uninterrupted or free of data loss; we recommend periodically exporting your data from the App.

10. Indemnification

You agree to indemnify, defend, and hold harmless Candidus LLC, its affiliates, officers, directors, employees, agents, suppliers, or licensors from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

11. Termination and Account Deletion

You may stop using the App and delete your account at any time, as described on our Delete Account page. Deleting your account does not cancel a subscription purchased through Apple or Google; you must cancel it in your App Store or Google Play account settings. We may suspend or terminate your access to the App if you violate these Terms.

12. Modifications to the App and These Terms

We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the App or any service to which it connects, with or without notice and without liability to you. We may update these Terms from time to time by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
